Gearbox grinding (metalic (ish) sound) ..... help/advice?

I had the gearbox oil changed... at the same time I went through and described about removing the sump and cleaning the labarinth filter. I even source a new gasket from J'pan...
Not sure if there was an issue before any of this was done but after it's certainly worse.... :(

What I got is a metallic disc scraping sound from the gearbox... only when it's cold... only when the gearbox is underload... once the speed of the gearbox has equalised the sound goes away.... Once warm the sound goes away no matter how hard I push it....
It doesn't seem to affect the gearbox performance (at the moment..) :?:

any ideas :?:

I had similar problems in my car before, turned out to be one of the drive shafts. I know its not the same layout but does sound like a very similar problem, I would guess the diff could be an issue too.
