Amazon or Tom Tom.

I was given a Tom Tom sat nav for Christmas, it's packed in, contacted Amazon with my order number etc they claim after 30 days my issue is with Tom Tom, whom I contacted, and after several updates, reboots, "repair my Tom Tom" downloads etc etc the dammed thing still is not working, but I am struggling to get Tom Tom to say send it back its faulty, Amazon don't want to know, under my consumer rights does anyone know whom I have a warranty issue with, is it Amazon or Tom Tom, IE the seller or the manufacturer.
