The mediation took place on the 19 th as arranged. I got a phone call from a lady who asked me to explain why I was making the claim, which I did and as I was advised to compromise I said I still wanted a refund but would not ask for the £205 pounds paid to the court. The lady then said she would hang up and phone algys to make the offer. A little while later she phoned me again to tell me that algys had said they would give me NOTHING as they had had to pay for the freight and other expenses. The lady said she would report the outcome back to the court. So what was the point of mediation?
last Tuesday 23rd I received an email from algys saying the bongo is in bristol and if still did not want it it could be sold as it owes as money and did I know anyone who wanted to buy it.
I replied I still did not want another bongo.
I did not know anyone who wanted to buy it.
I just want a refund of all my money.
Today I got a reply saying they would try and sell the bongo, and regards!!
Today I also got a letter from the court (Notice of Transfer of Proceedings) saying
"The Small Claim Mediation Team has arranged for you case to be transferred to a Hearing Centre as the mediation has been unsuccessful on your claim."
Something to so look forward to!

I now have the court hearing for the 21 September with a time estimate of 90 minutes.
I have to pay £346 for the privilege!
The letter encourages the parties to settle to try to settle the case by negotiation so
I am going to send one last email to algys to see if they have seen reason and settle
out of court.

The court hearing took place on Thursday 21st September.
After my and algys account of the case the judge said " I need a few moments to decide"
Then this is what she said
Judge to me " you did instruct algys to buy the vehicle for you?"
me -" yes but I was not aware of freight problems, they did not tell me, and in their
website the say lead time of 3 to 12 weeks"
Judge -" it says hear in their terms and conditions that the are not liable for any
delay"
me - " yes but they knew the delay was inevitable and I was not told"
Judge - " the vehicle is here now. So case DISMISSED "
I was gobsmacked.
So I have had to pay all the cost and collect the bongo from Bristol.
The bongo is quite good even though it has a few scratches.
I drove it from Bristol to my house and it was a lovely ride.
Lucky me, I now have two bongos.
It will be going to the for sale section in the next few days.
Anyone know of someone who might be interested?

Ouch painful, and not the best time of year to sell a new vehicle, might it be worth hanging on to it till Spring perhaps
